By placing an order with ABFA Technologies, you confirm that you are in agreement with and bound by the terms and conditions below.

The following terms and conditions are intended to be fair to all parties concerned and to aid in the supply of services. This agreement represents the complete agreement and understanding between ABFA Technologies and the client.

Definitions

The Client: The company or individual requesting the services of ABFA Technologies.
ABFA Technologies: Contractors providing website design and development services.

Payment of Accounts

The website, graphics and any programming code remain the property of ABFA Technologies until all outstanding accounts are paid in full. Upon final approval of the site design and development by client, the final deposit is required before all material is handed over to client.

Copyright and Trademarks

ABFA Technologies cannot take responsibility for any copyright infringements caused by materials submitted by the client. The client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to ABFA Technologies for inclusion in the web design project are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect and defend ABFA Technologies and its subcontractors from any claim or suit arising from the use of such elements furnished by the client.
We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

Completion Date and Project Delivery

The client agrees to make available to ABFA Technologies within one-week of commencement all materials required to complete the site to the agreed standard and within the set deadline.
In the event that the project is delayed past the specified time estimated for completion due to failure to produce the necessary material for completion, ABFA Technologies reserves the right to use standard filler text where appropriate and charge data entry fees at standard hourly rates, or to impose a surcharge of up to 25%. ABFA Technologies recommends that clients proceed only when they are ready and able to fulfill these obligations.
If at any point during the website development cycle a client wishes to cancel the commission of service, they may do so but will be invoiced an amount that ABFA Technologies judges at its sole discretion to be proportional to the amount of work completed on the commission.
If, during the website development cycle, the client does not supply the content required in order to complete the commission within a reasonable amount of time, ABFA Technologies will consider that the client wishes to cancel the commission. ABFA Technologies will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

Alterations

The customer agrees that changes required over and above the estimated work or required to be carried out after acceptance of the draft design will be liable to a separate charge. The customer also agrees that ABFA Technologies holds no responsibility for any amendments made by any third party, before or after a design is published.

Disclaimers

ABFA Technologies does not guaranty that the functionality of the Website will be uninterrupted or error free.

Limitation of Liability

ABFA Technologies will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) in relation to your use of the Website.

Once a website has been designed and completed, ABFA Technologies will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.

Acceptance of Quotation and Terms and Conditions

The placement of an order for development and/or any other services offered by ABFA Technologies and validated by the customer's signature on the estimate or quotation form, constitutes acceptance of the estimate or quotation and agreement to comply fully with all the Terms and Conditions and forms a Contract for Business between the signatory and ABFA Technologies.
